For An Act To Be Entitled

AN ACT TO ESTABLISH THE EIGHTY-SIXTH SESSION PROJECTS ACCOUNT WITHIN THE GENERAL IMPROVEMENT FUND; TO DEFINE THE MONIES TO BE AVAILABLE IN SUCH ACCOUNT; AND TO DEFINE THE PURPOSES FOR WHICH MONIES MAY BE MADE AVAILABLE FROM THE GENERAL IMPROVEMENT FUND SO THAT ADDITIONAL FUNDS CAN BE MADE AVAILABLE FOR THE STATE BUDGET; AND FOR OTHER PURPOSES.
Subtitle

THE DISTRIBUTION OF THE EIGHTY-SIXTH

SESSION PROJECTS ACCOUNT OF THE GENERAL

IMPROVEMENT FUND TO PROVIDE ADDITIONAL

FUNDS FOR THE STATE BUDGET.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:


SECTION 1. This Act may be cited as the "General Improvement Distribution Act of 2007".
SECTION 2. There is hereby created and established on the books of the Chief Fiscal Officer of the State, the State Treasurer and the State Auditor, the "86th Session Projects Account" within the "General Improvement Fund", into which shall be transferred and credited the respective monies as hereinafter provided in this Act, to be used for providing financing, in the manner set forth herein, for the various projects and purposes enumerated in this Act to be financed from said account.

Immediately upon the effective date of this Act, or as soon thereafter as is practical, the State Treasurer shall transfer and credit to the "86th Session Projects Account" of the "General Improvement Fund", upon certification of the amounts thereof by the Chief Fiscal Officer of the State, the following:

(a) all unobligated and unallocated monies remaining in the "General Improvement Fund" on June 30, 2007 which are not required to finance projects to be financed therefrom pursuant to appropriations enacted by the 85th General Assembly, or which have not been reappropriated or reallocated for financing from the "General Improvement Fund" by the 86th General Assembly;

(b) any unobligated or unallocated funds remaining on July 2, 2007 in the "General Revenue Allotment Reserve Fund" from monies accruing thereto during the 2005-2007 fiscal biennium which are not required to finance enactments of the 86th General Assembly that do not expire on June 30, 2007;

(c) interest earned on State Treasury fund balances as provided in this subsection. For the period commencing on July 1, 2007, and ending June 30, 2009, the State Treasurer shall, after complying with provisions of

(1) Arkansas Code 27-70-204 for distributing interest income earned from investment of average daily balances of the "State Highway and Transportation Department Fund",

(2) Arkansas Code 15-41-110 for distributing interest earned from investment of average daily balances of the "Game Protection Fund",

(3) Arkansas Code 15-5-422 for the first two million dollars ($2,000,000) of interest income received each fiscal year by the State Treasurer as authorized for the “Correction Facilities Construction Fund”, and

(4) Arkansas Code 20-78-504 for the next one hundred thousand dollars ($100,000) of interest income received each fiscal year by the State Treasurer for the “Arkansas Child Care Facilities Loan Guarantee Trust Fund”, credit to the "Budget Stabilization Trust Fund" or its successor fund, fifty percent (50%) of the interest income received and credited to the "Securities Reserve Fund", and credit to the "86th Session Projects Account" fifty percent (50%) of the interest income received and credited to the "Securities Reserve Fund" as certified by the Chief Fiscal Officer of the State, to provide financing to the "86th Session Projects Account", until there has been credited an amount, which when added to the other funds available for such purposes will finance each of the projects or purposes hereinafter enumerated;

(d) Those special revenues credited to the General Improvement Fund from estate taxes as set out in Arkansas Code 19-6-301(171);


SECTION 3. Of those moneys accruing to the 86th Session Projects Account of the General Improvement Fund as set out in Section 2 of this Act, the State Treasurer shall first set-aside $489,948,838. Such funds set-aside and made available under this section shall be used for any project or portion thereof enumerated within subsection (a) or (d) so long as the projects enumerated in subsection (a) are fully funded by June 30, 2009, but not to exceed the amount set out in subsection (a) for the project. The Chief Fiscal Officer of the State shall notify the Arkansas Legislative Council of the release of funds for projects enumerated in subsection (a) at the same time that the Department of Finance and Administration is notified.

(a) Public School Academic Facilities for the Transitional Academic

Facilities, Academic Facilities Partnership and Academic Equipment programs, $455,597,052;

Department of Correction, lease payments for Department Facilities, $12,500,000;

Department of Education - General Education Division, APSCN - Repayment of Loan to Teacher Retirement System, $5,800,586;

Arkansas Agriculture Department for construction and renovation of County and District Fairs, $847,200;

To be deposited into the General Revenue Fund Account of the State Apportionment Fund to be distributed as all other General Revenue to replace general revenue from the adoption of HB1223 of 2007 for the provisions of Section 179 of the Internal Revenue Code in Arkansas Code 26-51-428(a), $6,700,000;

Arkansas Natural Resources Commission, expenses for the Illinois River Conservation Reserve Improvement Program, $1,500,000;

State Board of Election Commissioners, Presidential Primary and Special Elections, $2,204,000;

University of Arkansas System to the various institutions and entities of the University of Arkansas System, for construction, renovation, maintenance, equipment and operational expenses, pursuant to HB1847 of 2007, $4,800,000;
(b) Then the Treasurer of State shall first make monthly allocations on the basis of eighty two and four tenths percent (82.4%) of the total available funds to the Executive Discretionary Division as set out in subsection (d) and the remainder of the total available funds to the Legislative Division listed in subsection (c). The Legislative Division funds shall be used to provide funds to each project enumerated in (c) of this section in proportion that each project's allocation bears to the total of the allocations of all projects enumerated in subsection (c). Additional funds that may be received by the General Improvement Fund after the projects in subsection (c) have been fully funded shall remain in the General Improvement Fund for such purpose as may be enacted by law, but shall not be a part of the 86th Session Projects Account. Funds made available to the Executive Discretionary Division may be used for any project or portion thereof enumerated within the Executive Discretionary Division but not to exceed the amount set out in subsection (d) for the project. The Chief Fiscal Officer of the State shall notify the Legislative Council of the Governor's released funds for projects at the same time that the Department of Finance and Administration is notified.
(c) LEGISLATIVE DIVISION. The Legislative Division shall consist of the following projects and with the maximum allocations as set out herein:



Arkansas Child Abuse/Rape/Domestic Violence Commission

For contractual obligations, grants to Children's Advocacy $46,429

Arkansas Agriculture Department

For a grant for expenses for Youth Livestock Shows $10,000

For construction and associated expenses for Farmers $471,429

Markets

For construction, renovation and equipment for the $137,750

Aquaculture Fisheries Center to improve facilities to

enhance fish health services for Arkansas Aqualculture

through disease diagnosis, treatment advice and inspection

services

For equipment upgrades and operating expenses of the $99,750

Aquaculture Fisheries Center Laboratory at Lake Village

For expenses of the Arkansas Agriculture Department $26,429

For grants for operating and program expenses for annual $45,000

festivals

For grants to the Arkansas State Fair for buildings and $100,000
